TERMS + CONDITIONS

For guests staying at the Greenhouse Retreats the following conditions apply.

For guests staying at the Greenhouse Retreats (“you”) the following conditions apply. By entering our property, you agree to these terms and conditions. 

 

Occupancy

No more than 8 Adults for the Greenhouse and 6 adults for the Beach house are to stay on the premises. No additional Guests allowed without our prior permission.

 

House Rules

We are prohibited from hosting any kind of function or event.

No smoking inside the house, around the pool or on the decks.

No Parties (dinner parties ok).

No noise or pool use after 10pm at night or before 7am in the morning.

No more than 8 adults per booking.

No under 25 year old Groups.

Please respect our neighbours by staying off their portion of land

between the houses and the water at the Greenhouse.

Please clean the BBQ if used .

Please put all dirty dishes in the dishwasher before checking out,

leaving dishes will incur an extra cleaning cost.

Any complaints made to the police for noise or disturbance will

result in 100% retention of the security deposit.

Did I mention no parties or events.

ANY ILLEGAL BEHAVIOUR OR EXTRA GUESTS FOUND

ON THE PROPERTY WILL RESULT IN INSTANT EVICTION. 

Please leave the house as you found it, additional cleaning required due to dishes being left, smoking or BBQ not being cleaned will result in extra cleaning fees being taken out of the security deposit.

 

Guests are invited to use all products and equipment including kayaks and gym at their own risk.

If using the sporting equipment including kayaks and Sups, please check all weather conditions

and tides prior to going out.

No children to use the gym or sporting equipment unsupervised.

Additional linen (other than what has been left out) charged at $10 a piece.

 

Check in and Check out 

 

Check in time is 2pm on the day of arrival and the room must be vacated by 10am on the day of departure. An additional fee may be charged if you do not check out by 10am. Early arrivals and late check outs are at the discretion of management, and must be requested at the time of booking. 

 

A fee of $40.00 is payable for any key that is lost or not returned by you. 

 

In the event that you request, and we agree, that a pet is to be permitted in the property, then you must pay an upfront $40.00 fee in respect of extra cleaning, and you are to make sure that the pets are not allowed on the furniture at any time. 

 

 

Identification and documentation 

 

Upon making a booking, you are to provide the details of a valid credit card, postal address, email and phone number. Prior to check in, you are to provide a copy of your driver’s licence and such other identification as is requested by us. 

 

Waste Management Policy

We endeavour to keep the amount of waste produced at our properties to an acceptable level and supply our quests with double the usual requirement of General Waste and Recycle Bins. We kindly ask guests to be thoughtful with their waste, use the recycling bin correctly by breaking down all boxes and recycle all waste in the appropriate ins. Excess rubbish left on the property over and above what is in the bins will be charged at $300 and will be deducted from the security deposit. 

 

Any Additional cleaning considered out of the ordinary (and that goes over the usual 6 Hours for the Greenhouse or 3 hours for the Beach House) eg dirty dishes, dirty bbq, stained linen will be charged at an hourly rate of $50 ph. 

 

Payments

50% of accomodation on Booking.

Balance 30 days prior to check in.

Security deposit due 2 days prior to check in $2000 -  this is via a capture funds transaction and is released after check out. If the deposit is not paid on time, then we reserve the right to re-let the property. 

 

Cancellations

100% Refund of deposit for cancellations 30 days in advance.

50% refund of deposit for cancellations less that 30 days.

No refunds for cancellations less than 14 days in advance.

No refunds for no shows.

Consideration for covid related cancellations apply for last minute change of date and cancellations

We are a covid safe house, for our full covid code of practice click here.  All guests are require to check in on arrival using our unique QR NSW Government Code

RESPECT THE LAND

We would like to acknowledge the traditional custodians of this land the Darkinjun and Guringai People, on which you will stand, and pay our respects to the Elders past and Present. We recognise their continuing connection to this land, these waters and our community. We ask you honour and act with the utmost respect for the duration of your stay.

 

SECURITY CAMERAS

 

We operate security cameras for the purpose of enhancing security, identifying guests on arrival and ensuring that the correct numbers of guests arrive at the property. 

 

KEYS 

 

In the event that you lose any key supplied to you, you agree to pay on demand a $40.00 replacement fee. 

 

ANIMALS 

 

If we permit you to bring a pet onto the property, then you are to pay a $40.00 fee in respect of additional required cleaning, and you must ensure that the pets are not permitted onto any furniture.

 

In the event that you leave any items behind, and we agree to post same to you or make other arrangements to have the goods returned to you, then you agree to pay on demand any anticipated or expended costs in respect of return of such goods. 

 

PARKING AND ACCESS 

 

You acknowledge that the driveway is relatively narrow. In the event that you need to reverse out of the property, you do so at your own risk and shall indemnify us in respect of any damage. 

 

PROOF OF IDENTITY

 

Upon making a booking, all guests are to prove a credit card, postage address, valid email and phone number, together with a copy of a valid and current driver’s licence. 

 

GUEST RESPONSIBILITY 

 

If any guest books the property on behalf of any other people, or otherwise permits other people to enter the property, then the person booking the accommodation is responsible in all respects for the property and for ensuring that all guests and visitors are aware of and comply with these Terms and Conditions. By making a booking, you promise that you are at least 25 years of age. 

 

In the event that items are left behind by guests, the guest is to pay such reasonable cost as is charged by us in respect of the return of such items. 

 

LIABILITY AND SECURITY DEPOSIT 

 

By making a booking, paying a deposit or entering the property, you agree that: 

 

  • You are responsible for all damage, breakages or incidents to or in respect of the property, furniture, fittings or any loss suffered by the owner of the property.

 

  • All fixtures, fittings, furniture, appliances in the property are assumed to be in good working order and condition at the commencement of your occupation of the property. If any such item is not in good working order, you must immediately notify us, so that a record can be maintained in respect of the condition of the item. Without such notification, the damage will be presumed to have been caused by you. 

 

  • You warrant that the number of persons staying the property will not at any time exceed the number specified on any booking form or other information supplied to Us. 

 

  • You agree that the property will be returned to the owner in the same functioning, clean and tidy condition that it was in when the property was made available to You. This includes….

 

Any guarantee, condition or warranty which would otherwise be implied in these Terms and Conditions or any other agreement between us and you is hereby excluded. 

To the extent that any legislation or other law implies any guarantee, condition or warranty which cannot be excluded: 

 

  • Such liability shall exclude any indirect, special or consequential damages; and

 

  • Our liability for breach of such guarantee, condition or warranty shall be limited at our option to; 

 

  • If the breach relates to goods, the replacement of the goods or the supply of equivalent goods; or

 

  • If the breach relates to services, the supplying of the services again or the cost of having the services supplied again.  

 

You acknowledge that you have not entered into these Terms and Conditions or any other agreement with us in reliance upon any statement (written or verbal) made by us or any representative or employee of us, other than as expressly agreed in writing between the parties. 

 

“Claim” means any loss, claim, or direct, indirect, incidental, punitive, special, consequential or other damages or loss of any kind whatsoever, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence) strict liability or otherwise arising from any source or cause whatsoever including the use of the Service or any associated goods or services, or any other claim related in any way to your use of the Service, and includes any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the usage of the Services or associated goods and services.  

 

You promise that you will comply with any Law that relates to the property, and will indemnify us in respect of any loss or claim that arises as a result of the breach of any Law. 

 

We are not to be held responsible or liable in respect of any building or construction work carried out on neighbouring, or any other source of noise or nuisance. 

 

You acknowledge that the driveway is narrow. Before entering the driveway, you warrant that you have ascertained that you will be in a position to navigate the driveway, including reversing, and you indemnify us in respect of any loss, damage or Claim that arises from the use of the driveway. 

 

SPORTING EQUIPMENT AND OTHER ITEMS

 

We may offer from time to time sporting and other equipment such as kayaks, stand-up paddle boards and life jackets. . By using, borrowing or agreeing to use or borrow such equipment, you do so in all respect at your own risk, and you shall not be entitled to make any Claim that relates to such equipment.  

 

We may engage third party contractors to provide services such as massage, yoga, private chef or other services. By engaging the services of such third party contractors, your entering into an agreement with such third party, and any Claim that relates to such services shall be directed to that third party. 

 

FORCE MAJURE 

 

You acknowledge that we reserve the right to move your booking in the event of any circumstances arising that are beyond our control. We shall not be liable to issue refunds for any items that are not within our control, such as fire, flood, storm damage, power outages or any other unforeseen circumstances.
